As the attorney for the estranged husband of missing New Canaan mom Jennifer Farber Dulos is asking the state to drop all charges against Fotis Dulos' girlfriend Michelle Troconis so she can testify in his favor, a judge has ruled in favor of Troconis saying she can leave the state this weekend.
Troconis is out on $500,000 bail on charges of tampering with evidence and hindering prosecution in connection with the disappearance of the mother of five on Friday, May 24.
The Superior Court judge ruled Friday, June 28 in favor of her attorney's request to allow her to leave the state to state with a friend beginning Sunday, June 30, and returning July 17.
The judge also ruled that Fotis Dulos and any of his representative are prohibited from contacting Troconis, and she is prohibited from contacting him.
The ruling comes as Attorney Norm Pattis, says Troconis can offer an alibi for his client, "Michelle provides Fotis a complete alibi for the morning of Ms. Dulos's disappearance," Fotis' Dulos' attorney, Norm Pattis said. "Yet most likely she will not testify so long as the state presses its meritless claims against her."
Troconis lived with Fotis Dulos along with her daughter after Jennifer Dulos moved out of the couple's Farmington home with their five children when she filed for divorce.
Troconis was arrested, along with Fotis Dulos, on Saturday, June 1, after video surveillance showed the duo dumping garbage bags containing items with Jennifer Dulos' blood on them in some 30 locations in Hartford.
"We are calling on the state to drop the charges against Michelle so that she is available to testify in Fotis's defense," he added. "We're asking that the charges against her be dropped so that she can feel free to testify without fearing the consequences."
Jennifer Dulos was reported missing after she failed to attend several meetings. Her SUV was later found abandoned near an area park.
Since that time, law enforcement officials have conducted a massive search, including at a Hartford trash facility and at the park where her vehicle was found. They are also following up on more than 1,000 tips received on a special tip line, said New Canaan Police Chief Leon Krolikowski.
"Our multijurisdictional law enforcement team is committed to (1) Finding Jennifer and (2) Bringing those responsible for Jennifer's disappearance to justice," Krolikowski said. "We will not rest until we find Jennifer."
